The short version
Hashtag Business LLC, doing business as Hochberg Sports Marketing (“HSM,” “we,” “us,” or “our”), runs hochbergsm.com and represents athletes and works with clubs and partners around the world. We take your privacy seriously. This Privacy Policy explains what we collect, why we collect it, how we use it, who we share it with, and the rights you have to control it.
If you only read one thing: we collect basic contact information from people who reach out to us, run standard website analytics (Google Analytics), and don’t sell your personal information. If you want your data deleted, email us at privacy@hochbergsm.com.
Who we are
Hashtag Business LLC is a New Jersey limited liability company doing business as Hochberg Sports Marketing. We are registered as a foreign LLC in the State of New York, where our principal office is located. We are the “data controller” (and, where applicable under California law, the “business”) responsible for any personal information processed through our website and in connection with the services we provide.

What this Policy covers
This Policy covers personal information we collect through:
• The hochbergsm.com website
• Email exchanges, contact forms, and inquiries you send us
• Our newsletter and other marketing communications you opt into
• Information shared with us in the course of representing athletes or working with clubs, leagues, sponsors, and other partners
It does not cover information collected by third-party websites we link to (for example, our Instagram page @hochbergsm or social platforms we may reference). Those services have their own privacy policies.
The personal information we collect
We collect only the information we need to run the business and respond to you. The categories include:
Identity and contact data — your name, email address, phone number, mailing address, company or club affiliation, and job title.
Athlete and professional data — if you are an athlete or club representative, information you provide to us in the course of representation discussions, scouting, or partnership work (for example, position, league, career history, performance information, public statistics). We only collect what you choose to share with us.
Correspondence— the content of emails, messages, and contact-form submissions you send us, including any attachments.
Marketing preferences — whether you’ve subscribed to our newsletter and your communication preferences.
Website technical data — your IP address, browser type and version, device type, operating system, the pages you visit on hochbergsm.com, referring URLs, and timestamps. This is collected automatically by Google Analytics and our hosting provider’s server logs.
Cookies — small text files stored on your device. See Section 7 below.
We do not intentionally collect any of the following “special category” or “sensitive” personal information through our website: government identifiers, financial account numbers, health information, race or ethnicity, religious beliefs, sexual orientation, biometric data, or precise geolocation. If you choose to share such information with us in correspondence (for example, an athlete’s medical history in the course of representation), we will treat it as confidential and process it only as needed for the purpose you provided it.
We do not knowingly collect personal information from children under 13. See Section 9.
How we collect personal information
We collect it three ways:
1. Directly from you when you fill out our contact form, subscribe to our newsletter, email us, or otherwise interact with us.
2. Automatically when you visit hochbergsm.com, through cookies, pixels, and our analytics provider.
3. From third parties and public sources when relevant to our work — for example, publicly available rosters, statistics, social-media profiles, news reports, or referrals from mutual contacts.
Why we use your personal information, and our legal basis
We use the information we collect for the purposes listed below. If you are located in the EU, UK, or another jurisdiction with a GDPR-style law, we have also noted the “legal basis” (the legal reason) we rely on to process your data for each purpose.
To respond to inquiries you send us. Our legal basis is the performance of a contract you’ve asked us to enter into, and our legitimate interest in operating our business.
To provide athlete-representation, marketing, and consulting services to our clients and counterparties. Our legal basis is the performance of a contract, and our legitimate interest in providing services.
To send our newsletter and marketing emails, only if you’ve opted in. Our legal basis is your consent, which you can withdraw at any time.
To run and improve hochbergsm.com, including analytics, security, and performance. Our legal basis is our legitimate interest in operating and improving our website.
To comply with legal, tax, accounting, and regulatory obligations. Our legal basis is compliance with a legal obligation.
To defend or assert legal claims if needed. Our legal basis is our legitimate interest in protecting our business.
We do not engage in automated decision-making or profiling that produces legal or similarly significant effects about you.
Who we share your personal information with
We share your information only with the following categories of recipients, and only as needed:
• Service providers acting on our behalf under written contracts, including: our website hosting provider, email and newsletter platform, Google (for Google Analytics), customer-relationship-management tools we use to manage outreach, and similar vendors.
• Professional advisors — our lawyers, accountants, and insurers — when needed and under duties of confidentiality.
• Clients, clubs, leagues, sponsors, and other counterparties when sharing is necessary to provide the services you or our client have asked us to provide. For example, if we represent you as an athlete, we will share relevant information with prospective clubs or sponsors as part of representation work.
• Government authorities or law enforcement if we are legally required to do so, such as in response to a valid subpoena or court order.
• A successor business if HSM is ever sold, merged, or restructured. Your information would be transferred under the same protections set out in this Policy.
We do not sell your personal information. We do not share it for cross-context behavioral advertising. (These terms come from California law — see Section 11.)
Cookies and analytics
We use Google Analytics to understand how visitors use hochbergsm.com so we can improve it. Google Analytics sets cookies that record information about your visit, such as the pages you view and roughly where you are (country/region level, not precise location).
We do not currently use advertising pixels (such as Meta/Facebook Pixel, TikTok Pixel, or LinkedIn Insight Tag). If we add any in the future, we will update this Policy and, where required by law, request your consent through a cookie banner.
Your choices. You can disable cookies in your browser settings or use Google’s opt-out browser add-on at https://tools.google.com/dlpage/gaoptout. If you’re in the EU or UK, you can also decline non-essential cookies through any cookie banner we display.
International data transfers
HSM is based in the United States. If you contact us from outside the US — including from the EU, UK, Canada, Mexico, Australia, or anywhere else — your personal information will be transferred to and stored in the United States, and may also be processed by our service providers in other countries.
US privacy law differs from the law in your country. To protect your information when we transfer it across borders, we rely on the following safeguards:
• For transfers from the EU, EEA, UK, or Switzerland: the European Commission’s Standard Contractual Clauses (and the UK International Data Transfer Addendum, where the UK is involved), included in our contracts with service providers. Where a service provider is certified under the EU-US Data Privacy Framework (or its UK Extension or Swiss-US bridge), we may also rely on that framework.
• For transfers from other regions: equivalent contractual protections with our service providers.

Children’s privacy
Hochbergsm.com is not directed to children under 13, and we do not knowingly collect personal information from anyone under 13. If you believe a child under 13 has provided us personal information, please contact us at privacy@hochbergsm.com and we will delete it.
Because HSM works in sports, we may, in the future, communicate with athletes who are minors (typically 13–17). When we do:
• We require a parent or legal guardian’s consent before we collect or process the minor’s personal information beyond what is necessary for an initial inquiry.
• A parent or guardian may at any time review, request deletion of, or refuse further collection of their child’s information by emailing privacy@hochbergsm.com.
• We do not use minors’ information for marketing.
If you are in the EU or UK and under 16 (or the age set by your member state), please ask a parent or guardian to contact us on your behalf.
How long we keep your information
We keep your personal information only as long as we need it for the purposes set out in this Policy, including legal, tax, and accounting requirements. As a general rule:
• Inquiry / contact-form data: up to 24 months after our last meaningful contact, unless the inquiry leads to an ongoing relationship.
• Newsletter list: until you unsubscribe or ask us to delete you.
• Client and counterparty records: for the duration of the engagement, plus up to 7 years afterward to comply with US tax record keeping requirements.
• Website analytics data: in line with Google Analytics defaults (currently up to 14 months for user-level data) unless we adjust this setting.
After these periods we delete, anonymize, or securely archive the information.
Your privacy rights
Depending on where you live, you have some or all of the following rights. We respond to verified requests for free within the timeframes required by law (generally 30 days under GDPR, 45 days under CCPA, with extensions where allowed). To exercise any right, email privacy@hochbergsm.com. We may need to verify your identity before responding.
If you are in the European Union, the EEA, the United Kingdom, or Switzerland (GDPR / UK GDPR)
You have the right to:
• Access the personal information we hold about you.
• Rectify inaccurate or incomplete information.
• Erase your information (“right to be forgotten”), subject to certain exceptions.
• Restrict how we process your information.
• Object to processing based on our legitimate interests, including direct marketing.
• Data portability — receive your information in a structured, commonly used, machine-readable format.
• Withdraw consent where we rely on consent (for example, marketing), at any time, without affecting prior lawful processing.
• Lodge a complaint with your local data protection authority. In the UK, that’s the Information Commissioner’s Office (ico.org.uk). In Ireland it’s the Data Protection Commission (dataprotection.ie). For other EU member states, see https://edpb.europa.eu/about-edpb/about-edpb/members_en.
If you are a California resident (CCPA / CPRA)
You have the right to:
• Know the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of third parties we share it with.
• Delete personal information we have collected from you, subject to certain exceptions.
• Correct inaccurate personal information.
• Opt out of “sale” and “sharing” of your personal information. We do not sell or share personal information as those terms are defined under California law, so there is nothing to opt out of, but we honor Global Privacy Control signals if your browser sends one.
• Limit the use of sensitive personal information. We do not use sensitive personal information for purposes that would trigger this right.
• Non-discrimination— we won’t deny services, charge different prices, or provide a different level of quality because you exercised a privacy right.
Categories of personal information we have collected in the last 12 months: identifiers (name, email, IP address), commercial information (services you’ve inquired about), internet activity information (pages viewed on our website), professional information (job title, employer/club). We collect this from you directly, from your device when you visit our site, and from publicly available sources. We share these categories only with the service providers and counterparties listed in Section 6.
To submit a request, email privacy@hochbergsm.com. You may use an authorized agent to submit a request — we will require written permission and may verify your identity.
If you are in another US state with a privacy law (Virginia, Colorado, Connecticut, Texas, Utah, Oregon, Montana, and others)
You have substantially the same rights as California residents — access, deletion, correction, opt-out of “targeted advertising” and “sale” (we don’t engage in either), and the right to appeal a denied request. Email privacy@hochbergsm.com to exercise these rights. If we deny your request, we will explain why and tell you how to appeal.
If you are in Canada (PIPEDA and provincial laws)
You have the right to access the personal information we hold about you, to ask us to correct it, and to withdraw consent. We follow the ten fair-information principles in PIPEDA. You may complain to the Office of the Privacy Commissioner of Canada (priv.gc.ca).
If you are in Australia (Privacy Act 1988)
You have the right to access the personal information we hold about you, ask us to correct it, and complain about how we handle your information. You may complain to the Office of the Australian Information Commissioner (oaic.gov.au).
If you are in Mexico (LFPDPPP)
See the Spanish-language Aviso de Privacidad summary in Section 16 below. You have ARCO rights (Access, Rectification, Cancellation, Opposition) plus the right to revoke consent and to limit the use or disclosure of your information. You may complain to the INAI (home.inai.org.mx).
How we keep your information safe
We use reasonable technical and organizational measures to protect personal information, including encryption in transit (HTTPS), access controls, and limiting access to people who need it. Our service providers are contractually required to do the same.
That said, no system is 100% secure. If we discover a personal data breach that affects you, we will notify you and the appropriate authorities as required by law (within 72 hours under GDPR).
Links to other websites
Hochbergsm.com may link to third-party websites — for example, our Instagram page, partner clubs, or news articles. We are not responsible for the privacy practices of those sites. Please review their privacy policies before sharing information with them.
Changes to this Policy
We may update this Policy from time to time. When we do, we will update the “Last updated” date at the top and, for material changes, we will post a more prominent notice on the website or notify you by email (if you’ve given us your address). Continued use of hochbergsm.com after a change means you accept the updated Policy.
